1. Accumulation Limits

(a) Accumulation Limit = R 3,000,000
(b) Any one Life Limit = R 1,000,000
(c) Conveyance Limit = R 1,000,000

2. Notice of Claim

Written notice of a claim must be given to TOURMED within 30 days after the happening of any circumstances giving rise to a claim. All certificates, information and evidence required by TOURMED shall be furnished in the form prescribed and without expense to TOURMED and must be submitted to TOURMED within 90 days following notification. After 90 days the onus shall rest with the Insured Person to prove that TOURMED was not prejudiced in any way as a result of the late notification.

3. Proof of Loss and Physical Examination

The claim forms must be properly completed and all evidence required by TOURMED shall be furnished in a timely manner at the Insured Person's expense and be in such form and of such nature as TOURMED may require. TOURMED may at our own expense conduct any medical examination or arrange for an autopsy to be carried out.

4. Compliance

The Insured Person must follow the advice or instruction of TOURMED otherwise TOURMED may decline to pay part or your entire claim.

5. Subrogation

TOURMED has the right to commence or take over legal proceedings in the Insured Person's name for the defence or settlement of any claim, or to sue or prosecute any other party to recover Monies payable by them at law. The Insured Person must co-operate with TOURMED and do nothing to hinder our rights.

6. Cancellation

  1. This Policy may be cancelled at any time by giving TOURMED 30 days written notice, in which case TOURMED will retain the proportion of premium calculated at pro-rata for the period that the Policy was in force.
  2. This Policy may be cancelled by TOURMED giving 30 days written notice if an Insured Person has been in breach of any of its Terms or Conditions in accordance with the South African Short Term Insurance Act of 1998, and any other subsequent legislation that may be enacted, in which case TOURMRD will refund the pro-rata portion of the premium for the un-expired Policy Period.

7. Currency

All amounts are shown in South Africa Rands (ZAR). If expenses are incurred in a foreign currency, then the rate of exchange used to calculate the amount payable will be the rate at the time of incurring the expense or suffering a loss.

8. South African Law

The laws of South Africa govern this Policy and any dispute or action in connection therewith shall be conducted and determined in South Africa.

9. Automatic Extension

TOURMED will automatically extend the Insured Person's cover for up to three calendar months from the date of the Insured Person's expected return to his or her Country of Residence if such return is put back due to the Insured's inability to travel due to an Injury or Illness for which a
claim is payable under this Policy.

10. Fraudulent Claims

If an Insured Person, or anyone acting on the Insured Person's behalf use any fraudulent means or devices to obtain any benefit under this Policy then any amount payable in respect of such claim shall be forfeited.

11. Claim Offset

There is no cover under this Policy for any loss of event or liability which is covered under any occupational injury enactment, or workers compensations enactment or any other insurance Policy, health or medical scheme or benefit or compensation of a similar nature, which is
payable by any other source.

12. Tax or Imposts

The onus will always be on an Insured Person to insure, correctly admit and pay any tax liability in consideration of any benefit being paid that may in any form whatsoever incur tax or imposts of any nature.

13. Liability

TOURMED shall not be liable or responsible for the negligence, wrongful acts and/or omissions of any legal and/or health care professional or any other person or persons or legal entity who provide direct or indirect service to any of the Insured Persons.

14. Recoveries

In the event of any payment under this Policy, all recoveries net of TOURMED’S actual recovery costs, will be distributed firstly to TOURMED for all amounts paid by TOURMED and any remainder will be paid to the Insured Person.

15. Secondary Insurance

The insurance provided under this Policy will be in excess over any other valid and collectable bond or insurance.
